Buying property in Kenya while living abroad is possible. The distance mainly changes how you verify information, sign documents and control payments.
The safest setup is one where no single person controls the property search, legal verification and money.
Use independent professionals
If the seller or agent introduces the lawyer, surveyor and valuer, you have one chain of information.
For a large purchase, appoint your own advocate and, where needed, your own surveyor or valuer.
The point is not that every seller is dishonest. It is that independent checks reduce the chance that the same mistake or conflict affects every part of the transaction.
Ask for the title details before sending money
A polished video tour is not due diligence.
Get the title or parcel details and have the official records checked.
A land search can help confirm registered ownership and entries against the title. Physical verification and survey checks may still be needed.
Send someone to the actual property
A remote buyer should still arrange a physical inspection.
The person on site should confirm:
- the property exists where advertised
- access is practical
- boundaries and beacons can be identified
- there are no obvious occupants or encroachments
- the surrounding area matches the description
- utilities and roads are as represented
For land, a licensed surveyor is much more useful than a relative standing at the roadside with a phone camera.
Control the payment path
Avoid sending the full purchase price to an individual simply because they are a relative, agent or “trusted person”.
Your advocate can structure deposits, stakeholder funds and completion payments so money is released against defined transaction steps.
Keep bank records, receipts and written payment instructions.
Put the transaction in writing
The land sale agreement should make the price, deposit, completion period, required documents and default terms clear.
If financing is involved, the agreement should also match the realistic time needed by the lender.
Verbal promises are particularly hard to manage from another country.
When a power of attorney may help
A buyer abroad may need another person to sign or act on their behalf.
Kenya’s land registration framework includes prescribed forms for powers of attorney, and the State Department for Lands publishes the relevant Land Registration Act forms.
A power of attorney is a serious authority. Do not use a generic downloaded document and assume it is sufficient for a land transaction.
Ask your advocate whether you need one, what powers it should contain and how it must be executed and registered.
Check taxes and transfer costs early
Remote buyers often focus on the purchase price and discover transaction costs late.
Depending on the property, budget for:
- stamp duty
- legal fees
- valuation
- searches
- survey work
- registration fees
- consent fees
- financing costs

Confirm the seller’s authority
If the registered owner is a company, estate or someone acting through a power of attorney, the person signing must have authority to sell.
That can require company documents, succession documents, resolutions or a registered power of attorney.
The name in a WhatsApp profile is not evidence of authority.
Keep a digital completion file
Store copies of:
- title documents
- official searches
- survey material
- identification documents
- sale agreement
- payment records
- tax receipts
- consent documents
- transfer documents
- registered title after completion
A clean digital file is especially useful when you are not physically present to collect every document yourself.
Be suspicious of artificial urgency
“Another buyer is paying tomorrow” is not a reason to skip a search.
A legitimate seller may have other offers, but you still need enough time to verify what you are buying.
Distance already makes verification harder. Do not make it harder again by accepting a deadline designed to stop you checking the property.
The best remote purchase is boring
A safe diaspora transaction usually feels slower than the sales pitch.
Documents are checked. The site is inspected. Questions are answered in writing. Money moves through traceable channels. Completion documents are reviewed before the balance is released.
That is exactly what you want when buying property from thousands of kilometres away.
