Land Rates vs Land Rent in Kenya: What Property Owners Pay

Land rates and land rent are different property charges in Kenya. Learn who collects each one, when they apply and what to check before a transfer.

Land rates and land rent sound similar, but they are not the same charge.

The distinction matters when you own property, conduct due diligence or prepare a transfer.

Land rates

Land rates are county charges on rateable property.

County governments assess and collect them under the applicable rating and county revenue framework.

The amount can depend on the county, valuation roll and property classification. That is why quoting one national “land rates percentage” is misleading.

For example, Nairobi City County describes its land rates service as assessment and billing based on the unimproved site value.

If you are buying property, check the relevant county’s current account for the parcel and ask for evidence of any required clearance.

Land rent

Land rent is different.

It commonly arises where land is held under a lease from the government and the lease reserves an annual rent.

The State Department for Lands provides land rent services through its land administration systems. Its published Ardhisasa guidance allows users to search the parcel or title and view land rent invoices where the service applies.

A freehold parcel does not automatically have government land rent simply because it has a title deed.

Why buyers confuse the two

Both can appear in the paperwork around a transfer, and both may need attention before completion.

But they answer different questions:

A property may have one, both or neither in the way a buyer expects, depending on its tenure and location.

How to check land rates

Start with the county where the property is located.

The process differs by county, but you typically need the property or rates account details to check the current bill.

Do not accept “rates are cleared” without evidence if clearance matters to the transfer.

For Nairobi property, use the current Nairobi City County revenue channels rather than an old payment instruction from a blog.

How to check land rent

For properties where government land rent applies, use the State Department for Lands or Ardhisasa process.

The Ministry’s land services downloads include a land rent payment user guide, and Ardhisasa provides land administration services.

The invoice generated for the actual parcel is more useful than a generic estimate.

Why arrears matter during a sale

A buyer does not want to discover an unresolved rates or rent balance after assuming the transaction is ready to complete.

Clearance requirements can affect the documents needed for registration.

The older paper process often produced separate clearance certificates. Digital workflows continue to evolve, so your advocate should confirm what the relevant registry and county require for the specific transaction.

Rates and rent are not stamp duty

These are three different costs.

Land rates: county property charge.

Land rent: rent under the relevant leasehold arrangement.

Stamp duty: tax on the legal instrument used for a transaction such as a property transfer.

The simple distinction to remember

Rates go to the county because the property is rateable. Rent arises from the leasehold interest where rent has been reserved.

Before buying, check the actual account position for the property. Do not budget from a generic figure found online.
